Buildings
The word 'Buildings' means the Buildings (including outside Fixtures attached or belonging thereto), Landlord's Fixtures and Fittings therein and thereon, Outbuildings, Walls, Gates, Fences, Foundations, Macadam Paths Car Parks and Surrounds around and belonging thereto.

This will include any structural alterations or internal decorations made by the insured to the insured premises.

Fixtures & Fittings
Means the Machinery, Plant, Business Furniture, Fixtures and Fittings, Utensils, Packing Materials and all other Contents the property of the Insured, other than the Stock and Materials in Trade.

Frozen Food
Designed to cover the contents of the insured's Frozen Food cabinets or Refrigerators in the Premises up to the Sum Insured shown in the Schedule against DETERIORATION or PUTREFACTION due to a change in temperature following:-

(1) breakdown of the refrigerating machinery
(2) failure of the public electricity or gas supply
(3) the action of refrigerant fumes escaping from the equipment or
(4) the blowing of domestic fuses.

Business interruption
Also known as Consequential Loss, this is designed to cover the Insureds loss of trading profits following a loss which occurs under one of the insured perils on the policy.

Loss of Licence
Designed to compensate the Insured in respect of depreciation in value of the interest of the Insured in the premises due to the forfeiture of the Licence.

Money
Designed to cover the loss of money while in transit to & from the bank and the insureds premises and within the insured premises and at the private residence of the Insured.

Goods in transit
Designed to include the property shown in the Schedule against ALL RISKS OF PHYSICAL LOSS OR DAMAGE within the Geographical Limits shown below whilst carried in the Insured's own vehicle and/or trailers and/or containers or other methods of dispatch declared to Insurers up to the limits specified in the Schedule

Public Liability
Designed to indemnify the Insured against legal liability for damages and reasonable costs and expenses in respect of accidental Bodily Injury to any person or accidental loss of or damage to Property occurring during the Period of Insurance within the Territorial Limits in connection with the Business up to the Limit of Indemnity specified in the Schedule.

Products Liability
Designed to indemnify the Insured against legal liability for Accidental Bodily Injury to any person or accidental loss of or damage to Property occurring during the Period of Insurance within the Territorial Limits out of any products (after they have ceased to be under the possession or control of the Insured) manufactured, sold, supplied, altered, distributed, constructed, repaired, serviced, treated or installed or let on hire by the Insured up to the Limit of Indemnity specified in the Schedule.

Employers Liability
Designed to indemnify the Insured against legal liability for damages and reasonable costs and expenses in respect of accidental Bodily Injury caused during the Period of Insurance to any Employee and arising out of and in the course of Employment by the Insured within the Territorial Limits in connection with the Business.

Treatment Risk
Designed to extend Liability to include the administration of treatment by the Insured in respect of the business description described in the policy schedule

Sub-Contractors, Liabilities and the Law
There is a great deal of confusion regarding the legal obligations of a Tradesman in respect of the sub-contractors he may employ. In an effort to clarify the situation we would like to advise the following:

Sub-contractors are split into the following two groups, bona fide sub-contractors and labour only sub- contractors. Bona fide sub- contractors provide a service which includes materials and labour, while the latter, as their name implies, supply only labour. Thereby, a plasterer who gives a price for plastering a wall and provides an invoice for both materials and labour is a bona fide sub- contractor, while a plasterer who works for an hourly or weekly rate is not, regardless of the fact that he regards himself as self employed.

Labour only sub- contractors are employees of the contractor who employs them and they enjoy the same protection within the law as direct 'cards in' employees, that is to say that should they injure themselves in the course of their employment through an incident which could be blamed on the negligence of their employer, then they have the right to sue their employer for damages. Furthermore, liability for property damage or injury caused by them can be passed to their employer.

Your insurance policy will indemnify you against such claims, provided that you have declared the correct number of employees, including sub- contractors,(or included them in the wages roll declaration given at the inception or renewal of your policy).

Bone fide sub- contractors would be expected to have their own public liability cover, however if they do not have cover, or the cover that they have is insufficient, then any property damage or injury claim against them may revert to the main contractor who employs them.

Some liability policies give contingency cover against such claims up to defined limits, usually limited by the amount that you pay to bona fide sub- contractors over a 12 month period. Other policies give no contingency cover unless it is specifically requested.

Liability claims, particularly those involving injury or fatality, can result in damages and litigation costs that could cause financial ruin without adequate insurance cover. Any substantial claim would involve an investigation by the insurers of your annual accounts to establish the turnover and wages roll and any discrepancy could invalidate the claim.

It is vital that you advise us of all the people that you employ of whatever category so that we can ensure that you have adequate cover.
